Appeals filed by Apple in VirnetX trial denied

VirnetX-Apple

Yesterday, Apple was hit with bad news. The open judgment that he maintains with VirnetX, a North American company based in Nevada and mainly engaged in the acquisition of patents and litigation with companies, on the case of patent impersonation, wrote a new chapter yesterday.

The Court for the Eastern District of Texas ruled against the Californian company and challenged the appeals made by Apple, so the trial is moving forward and is not favorable for the Cupertino boys. At stake, a total compensation of about $ 439.7 million, related to patents that affect services such as FaceTime.

Despite this, there are still sentence appeals to be made, as well as the final conclusion of the trial. The motions denied by the District Court are as follows:

  •  Motion for trial as a law of non-infringement.
  • Law on damages.
  • Motion for a new trial for infraction.
  • And damages for the latter.

As a result, a final amount of the judgment that comes out to pay around $ 302.4 million, as decreed by a jury, in addition to a $ 41.3 million willful infringement penalty, as well as attorney's fees, valued at $ 96 million.

However, Apple confirmed to TechCrunch who plans to appeal the sentences on the movements. So far, all patents for VirnetX are in stand-by, due to more ongoing appeals. The lawsuit has continued since it was discovered that Apple voluntarily infringed on the patent portfolio in applications such as FaceTime and iMessage.

The first chapter of this novel was written in mid-2015. After a week studying the case, the jury of the Federal District of eastern Texas made a unanimous decision against the use of FaceTime and iMessage services, among others. Apple was ordered to pay $ 625 million, but it appealed, having a second assault last summer of 2016.
