Apple's latest patent battle against VirnetX will not have a retrial

Apple has been fighting the patent troll VirnetX since 2010. As patent cases, these often take many years to bring to trial. Unfortunately, in all of them, the Cupertino-based company has lost and has been forced to pay several hundred million dollars.

VirnetX's latest lawsuit is related to FaceTime and the technology it uses, technology that is registered under the name of this patent troll, lawsuit that Apple lost and was forced to pay 502,6 million dollars.

Apple requested that the trial be repeated, but as we can read in Bloomberg, Tim Cook's company will not have a second chance, since the United States court of appeals court has rejected the request to reconsider the decision made last November in which Apple was found guilty of infringe two VirnetX patents.

During the course of the trial, two other cases of patent infringement were annulled, while another two were admitted, more than enough reason for Apple requested that it be repeated , something that unfortunately will not happen.

The $ 502,6 million that Apple had to pay VirnetX was deposited with the court when the sentence was announced. At least Apple has managed to have the court ruling sent to a lower court to see if they can be recalculate quantified damages.

As I have commented, the history of judicial fights between Apple and VirnetX goes back a long way, although the trials have lasted many years. In January 2019, another court ordered Apple to pay $ 440 million to VirnetX, a sentence that Apple appealed without success.

Microsoft and Google are other large technology companies that they have faced VirnetX with the same result. Big tech is tired of patent trolls getting rich at the cost of buying companies that are about to close with the sole desire to get their patents to sue the biggest.
