Apple's latest court victory requires Samsung to swap out its devices

trial courts

El United States Court of Appeals ruled this Thursday that Apple is entitled to a court order that would ban Samsung from using its technology patented on your devices. The decision could obligate to the Korean manufacturer to change certain features on their smartphones and tablets.

At the heart of the matter are 3 functions of software that Apple had patented: finger unlocking a device's touch screen, automatic correction of spelling errors, and the quick link, which allows the user to do things like tap a phone number within text to make a call.

Apple and Samsung went to court over these same patents last summer, and was rewarded with $ 119.6 million in damages. But US District Court Judge Lucy Koh denied the request to ban devices that include these features.

Apple didn't give up, and appealed Koh's judgment, and on Thursday the Court of Appeals ruled in his favor 2-1.

Apple cannot establish that these characteristics are the reason customers bought Samsung phones instead of Apple phones. It is only enough that Apple has shown that these characteristics were related to the offense, and it was important to customers when they were considering their options for buying a phone.

In response to the ruling, an Apple spokesperson issued the following statement:

We are very grateful to the jury and court for their service. Today's ruling reinforces what courts around the world have already found: that Samsung deliberately stole our ideas y they copied our products. We are fighting to defend the hard work that goes into beloved products like the iPhone, which our employees dedicate their lives to designing and delivering to our customers.

For Apple, getting a court order like this means much more than a cash settlement (remember that Apple has a few $ 200 billion in the bank). Since it started its legal battle in 2011, the company has always maintained that its goal was to stop Samsung from copying its technology, and that is why they have embarked so many times in court. And that means that Samsung from now on, can't use these three patents.

I think it is the correct way to understand how it is understood that the manufacturer's right is protected.
and that a patent is protected from the right that corresponds to it.
